The Marketing Business Affairs & Contracts Manager is a role on the Global Marketing team that provides guidance for the contracts related to services outsourced by the marketing team including agency services, production services, influencers & partnerships, contract labor, software licenses and other general marketing services. Additionally, the Manager will provide related expense support such as reviewing fees, POs, invoices, etc. as needed.
The Manager will collaborate with Marketing, Legal, Finance and Accounting team members from Whole Foods Market / Amazon on a regular basis – as well as engage directly with agencies, partners, contractors and vendors as necessary. The Manager may have extensive contact with some vendors, and less extensive or no contact with others, dependent on needs and complexity of contracts.
The Manager will serve as a key partner to create standardization and consistency in processes related to partner evaluations, vendor selection, Terms & SOWs, fee schedules, vendor activation, PO & invoicing processes, contract expiration / renewals / terminations and general oversight of the Marketing contracts database.
The Marketing Business Affairs & Contracts Manager is a member of the Global Marketing – Marketing Operations Team, reporting to the Senior Team Leader of Marketing Operations & Production.

Responsibilities:

  • Conduct regular database audits to maintain current Legal documents for all suppliers
  • Perform as key contributor in formal RFP evaluations, managing process, spiriting fairness in evaluation, aligning with legal requirements, and collaborating with Marketing Team on crafting SOWs
  • Collaborate with Marketing Team Members day-to-day on NDAs, MSAs and SOWs
  • Create and communicate standard guidelines and best practices for contracts and new vendor set up including: payment terms, travel policies, non-compete terms, confidentiality requirements, data compliance, etc.
  • Possess general knowledge of usage rights and licensing in the areas of talent, music, fonts, social influencers, photography, creative assets and work product and terms to advise Marketing Team Members and assist in negotiations
  • Collaborate regularly with Assets Manager to gate/remove accessibility to assets according to usage rights terms
  • Assist Legal in any inquiries related to usage rights and compliance
  • Review compensation compared to similar Whole Foods Market contracts and against industry benchmarks to ensure competitive, yet fair compensation
  • Align Whole Foods Market with like-minded and shared-mission organizations to create win-win partnerships for our brand and all of our partners.

Qualifications:

  • Bachelor's degree in Marketing, Communications, Legal, Finance or related field and 2-4+ years of experience OR equivalent combination of education and professional experience in Marketing, including contract detail management and exposure to negotiations
  • Experience with Onit, Sharepoint, Cumulus, Workfront a plus
  • Passion for details and organization at all levels, with vision for broader goals
  • Familiarity with Marketing disciplines including Production, Media, Contract Labor, SaaS, and Rights & Usage (talent, photography, fonts, etc.) Union Talent & Residuals experience a plus.
  • Influencer contract experience (especially Social, Video, Digital content) a plus
  • Multi-tasker at heart; true passion for proactive planning of details & timelines, paired with comfort operating at the speed of retail and agility to manage quick changes
  • Keen listener to understand Team needs and collaborate for solutions
  • Tireless relationship and consensus builder
  • Resourceful self-starter, comfortable with ambiguity and continuous change
