Billd is seeking Director – Legal and Commercial Agreements to develop and manage Billd’s collection and contract enforcement strategy.  Additionally, the role will work with General Counsel to support a variety of legal needs for a growing technology and lending company. You will be an integral member of the legal team to develop collection strategies and will report to General Counsel and the CEO. To excel in this role, you’ll be a self-starter who enjoys working in a dynamic, fast-paced environment and welcomes the challenge of tackling a variety of legal projects.

Responsibilities will be around three core areas of focus: collections, lien enforcement and general corporate matters. 

• Collections: develop best in class process, documents and collection strategy to mitigate company’s lending risk. This will include creating a standard document package and process to pursue delinquent accounts in a cost-effective manner.  Additionally, the role will manage litigation on delinquent accounts and work with outside counsel to improve collection results.  In some cases, when applicable will lead litigation efforts directly with the court. 
• Lien Enforcement: includes providing legal interpretation of statutory supplier and contractor lien filing requirements and provide sound advice on how to improve lien enforcement. While this business unit operates independently, legal counsel will be work with operations and credit to improve risk mitigation strategies.
• General Counsel: Work with General Counsel and CEO on corporate governance, commercial and lending agreements with customers and vendors, regulatory compliance, intellectual property protection, employment matters, and manage outside legal counsel.  

Other Responsibilities:

• Overseeing the legal matters of collections and litigation
• Review and negotiate partnership agreements
• Maintain knowledge of Billd operational and legal documentation including corporate governance, master commercial lending agreements, purchase statements, non-disclosures, employment agreements, and privacy statements.
• Provide advice and guidance related to compliance with key lending regulations, federal and state privacy and data security regulations and laws, including working with Billd’s business, technology and compliance teams to advise on, develop and implement appropriate practices, policies, procedures and legal controls.
• Assist in Billd’s Intellectual Property strategy including managing patent applications with general counsel and protecting Billd trade secrets.
• Assist in maintaining legal documents and proceedings for the company

Experience

• Juris Doctor degree from accredited law school
• 4+ years of practice with an established law firm or general counsel
• Experience in commercial lending preferred but not required
• Experience with collections, litigation and contract enforcement
• Experience with statutory lien regulation is preferred but not required
• Excellent verbal and written communication skills
• Proficient understanding of business sensitivities and confidentiality
