Mackie Wolf Zientz & Mann is seeking an experienced litigation attorney to handle mortgage-related litigation files as lead counsel in State and Federal courts in Texas. The attorney in this position will draft and file pleadings and motions, manage cases from inception through resolution, and represent clients in contested matters and hearings. The attorney will communicate daily with clients, borrowers, and opposing counsel. Court appearances and hearing attendance required. This position is in-office.


Essential Functions

- Provide legal advice to the Firm’s mortgage servicing clients. Communicate with clients through a combination of phone, email and client database systems;

- Research and analyze legal sources such as statutes, recorded judicial decisions, legal articles, treaties, constitutions, and legal codes.

- Prepare legal briefs, pleadings, appeals, contracts, and any other necessary legal documentation during the course of litigation in State Court and Federal District Court.

- Handle civil litigation cases from referral to resolution, which may necessitate the use of written and oral advocacy, motion practice, discovery, trial preparation, trial, and appellate court briefing and argument.

- Participation in mediation, willingness and ability to understand complex loan documentation and loss mitigation processes.

- Review work product of staff (comprised of legal assistants and processors) for accuracy;

- Maintain a current knowledge of any trends, regulations or legislation affecting the assigned area of practice;

- Settle cases and attend hearings;

-  Perform additional duties as requested.

Position Preferences:

- Juris Doctorate;

-  Licensed to practice law in the State and Federal Courts in Texas.

- 2+ years’ experience preferred in finance or representation of financial institutions in real estate related matters.

- Exceptional communication skills (oral and written).

-  Ability to work through complex mortgage-related issues.

-  Must be PC literate and able to rapidly adapt to a variety of data base systems including but not limited to Microsoft Word;

-  Ability to represent the company in various forums to foster the desires and image of the company in the community.
